The Forum Forge, hereby referred to as The Forum Forge, provides services all of which are subject to the terms and conditions outlined in this agreement. By using services provided by The Forum Forge, the client, hereby referred to as the 'Customer' agrees to abide by all three of these policies unless an exception has been provided by The Forum Forge in writing. By using The Forum Forge services, the Customer agrees to comply with all three documents, and upon purchase the Customer agrees to these legally binding agreements.

These policies are exclusively governed by the laws of the United Kingdom. Objections in relation but not limited to the Customer's service, the Company and/or these conditions may exclusively be heard in a court of the United Kingdom.

Services

The Forum Forge agrees to provision the services outlined and paid for in the order unless otherwise stated. The Forum Forge reserves the right to refuse, suspend or terminate service to anyone in violation of this agreement, or in the event of insolvency. By ordering any services from The Forum Forge, the Customer agrees to provide current, up-to-date information with regards to their personal contact details and other information stored in our system. The Forum Forge reserves the right to terminate any services provided to Customers where false or fraudulent information has been provided. Upon sign up, the Customers also agrees to the Account Transfer Policy outlining how account ownership can be transferred to another person.

Payment

The Forum Forge will not make available or continue to provide any service where a client has not paid the outstanding amount in full. To cancel a service with The Forum Forge, the Customer must provide at least 14 days notice. The Customer accepts that, should they fail to provide adequate cancellation notice, they may be charged for the next billing term. The Forum Forge reserves the right to charge additional 'late payment' fees as a penalty for overdue payment on a per-invoice basis, which shall not exceed twice the amount the Customer is paying for the concerned service(s) which are overdue on the respective payment terms for each term overdue. Should the Customer fail to pay by the invoice's due date, The Forum Forge reserves the right to terminate their services at any point, irrespective of the number of warnings that they may have received, or if a suspension has been imposed upon the account. In order to cancel, all outstanding bills must be paid in full, including any existing invoices already issued by the The Forum Forge system. If the Customer fails or refuses to pay The Forum Forge the full amount owed, then The Forum Forge reserves the right to refer their non-payment to a debt collector. Following a debt collector being assigned and sent the instruction, the Customer agrees to pay any additional fees incurred by collecting the outstanding debt.

Refunds

The Forum Forge does not offer backdated or pro-rated refunds for any Customers cancelling their services early unless otherwise specified. Should the Customer not be satisfied with the service that they have received from The Forum Forge within the first thirty (30) days of their service, then they may cancel their service free of penalty in exchange for a full refund, excluding the price paid for any domains. The 30 Day Money back guarantee is limited to Shared Hosting customers only.

Customers who are terminated or suspended for the abuse of services provided by The Forum Forge are not eligible for any form of refund, irrespective of their eligibility for the thirty day money back guarantee.

Affiliates

The Forum Forge operates an “affiliates scheme” which provides payouts to clients who refer other customers who subsequently purchase products from The Forum Forge. The company reserves the right to adjust, deny or accept payout requests at any time, and the client is only eligible for the funds which they have earned through referral sign ups after The Forum Forge have approved their request.

Damages and Losses

The Forum Forge will not take any responsibility for any damages and/or losses incurred by the Customer using its services. The Customer accepts and assumes full responsibility for managing and backing up all of their data held on their account.

Prohibited Material

The Customer agrees not to promote, upload, download, post, transmit or store data which contradicts the terms outlined by the Company using or on the service(s) provided to them, and assumes full responsibility for any material on or changes performed to their account(s). The Customer may not upload material which is deemed unlawful by their resident country, UK or US law. Content which is offensive, defamatory, illicit or pornographic is prohibited. Other content includes, but is not limited to, copyright protected material without permission of the copyright owner, warez, high resource usage programming, phishing sites and pyramid schemes. The Forum Forge reserves the right to define what material is classified as prohibited and take action against the Customer on a case-by-case basis.

Abuse

Abuse includes, but is not limited to:-

The Forum Forge takes the sending or transmission of Unsolicited Commercial E-mail or SPAM very seriously, and operates a zero-tolerance policy. The Customer remains solely responsible for ensuring the security of their account, and remains fully liable for any abuses which take place under it.

Upon receiving a complaint, the Company will launch a prompt investigation, and will notify the Customer of a violation. Depending on the severity of the violation, the Customer's account may be suspended or, in exceptional circumstances, terminated. Should the Company believe the violation committed to be a criminal offense, law enforcement officials will be notified. The Company will remain fully compliant with law enforcement agencies should an investigation be conducted.

Should the Customer's account be used intentionally or otherwise to send or transmit Unsolicited Commercial E-mail/SPAM through services provided by the Company, The Forum Forge reserves the right to apply an "Administrative" penalty not exceeding $800 USD to the account concerned. In addition to this, The Forum Forge reserves the right to charge "Research" fees not exceeding $200 USD per hour that The Forum Forge personnel must spend to investigate the matter. PLEASE, DO NOT SPAM from your account.

Disclaimer of Warranties

The Forum Forge is under no duty, and does not by this policy undertake a duty to monitor and/or police its clients activities and disclaims any responsibility for abuse through or on its network. Enquiries regarding this policy should be sent to the abuse E-mail address shown on the contact page.

Here at The Forum Forge, we care about the privacy of our clients, so we have created this policy to tell you what measures we take to protect personal information.

Gathering of Information

The Forum Forge requires up-to-date contact, billing and any other required information relevant to the Customer's service in order to communicate with them effectively. Such details are also gathered for billing, administrative and support purposes.

From time to time, The Forum Forge will place a cookie on the Customer's computer which enables the company to identify the Customer for authentication and other such purposes. This information will not be used to log activities either on or outside of the The Forum Forge website.

When visiting the The Forum Forge website, a unique identifier for the Customer's computer or network called an IP address may be logged by the The Forum Forge system in the interests of security and the collection of visitor statistics. An IP address cannot be used to identify the identity of a particular user, but it can be used to trace a visit to it's originating network.

Sharing of Information

By requesting a SSL certificate or other service from The Forum Forge provided by another company, the Customer agrees to allow us to share the relevant information with the issuing organisation in order to proceed with the setup process. Otherwise, the Customer's information will be kept entirely confidential at all times unless a court order or authorisation is provided by the Customer giving The Forum Forge authorization to distribute any required details.

By purchasing a domain through The Forum Forge, the Customer agrees to the Company making available 'WHOIS' information for the domain purchased. This includes the registrant's name, company, address, contact phone number and E-mail address. Customers can opt-out from this information being placed on the WHOIS database by contacting Sales, or by enabling ID Protection, included free with all domains.

Invoices sent by The Forum Forge are billed using PayPal, and by using this method you also agree to share your data with them according to their Terms, Privacy Policy and any other conditions that may apply.

Data Security

The Forum Forge recommends that the Customer changes their login passwords on a regular basis in the interest of information security. The Forum Forge stores all passwords in a secure database with key client information, but does not retain payment information with the exception of PayPal payment data so that we can refer to a transaction in the future if necessary.

Please be aware that this policy only applies to existing users of our services, and not those switching from other web hosts. Whilst we are more than happy to transfer any account between users as requested, verification and decision making processes can take days, and so we advise that any accounts that are likely to be transferred should be placed under a company or individuals name who should be responsible for the mediation of a transfer.

SSL Certificates are non-transferable, and contact should be made with us in the event that you wish to transfer a domain. For any domain related transfer requests, we will have to become either your new registrar or be your current registrar in order to take appropriate action.

By registering, transferring, renewing or managing a domain through the Company, the Customer agrees to the best of their knowledge and belief that the domain registered does not infringe upon the legal rights of another entity, and agrees not to use the domain for any unlawful purpose.

The Forum Forge agrees to provide domain registration and management services provided that (a) all conditions specified in this agreement are met, and (b) all services are paid for in full. Incorrect domain registrations, irrespective of whichever party is at fault, are still at the Customer's expense. The Customer agrees that all domain registration, transfer and/or management fees may not be refunded or credited to the Customer's account account in any way.

The Forum Forge, Business Transit or the Registry reserve the right to terminate the Customer's domain registration should information provided by the Customer in connection to this service be believed to be false, inaccurate, incomplete, secretive, unreliable or misleading. By purchasing domain related services from the Company, the Customer agrees to provide accurate and up-to-date information and maintain this throughout the lifetime of their domain(s). The Customer understands and agrees that failure to do so will result in the entitlement of the Registry, Business Transit or The Forum Forge to terminate this agreement immediately upon such breach without any refund or reimbursement and without any notice to the Customer.

This contract will remain throughout the length of the Customer's Domain Registration, from the point of selection to the point of cancellation or expiry, and will automatically renew should the Customer choose to lengthen the term of the Domain Registration. In the event that the domain is transferred to another Registrar by the Customer, this contract will cease thirty days after the transfer has successfully completed.

The Customer agrees to maintain the security of their account with the Company, and prevent it from any unauthorised use. In no event shall the Company be held liable for the unauthorised use or misuse of their account.

The Customer and any third parties agree to hold Business Transit, The Forum Forge, the registry, associated contractors, partners, employees, officers, directors and organisations harmless from all claims and expenses, including any legal fees, liabilities and any other obligations. These obligations will survive the termination or expiration of this Contract.

Should the Customer fail to abide by any provision of this Contract, then we may attempt to provide a written notice to the account holder on file, describing the violation(s). If within thirty (30) calendar days of the date of such notice, the Customer fails to provide evidence which is deemed satisfactory by the Company that the obligations under this agreement have not been breached, then we reserve the right to delete the registration or reservation of this domain name. Any such violation or failure to provide evidence shall not be excused for any reason, irrespective of circumstances.

The Customer acknowledges that the reservation, registration, transferral or renewal of the Customer's chosen domain name does not provide immunity from objection to the registration, reservation, transferral, renewal or use of the domain name. We fully reserve the right to refuse to register the Customer's chosen domain name or for any other services, and should the Customer attempt to register following the refusal of service to the Customer, the Customer agrees to pay "Violation fees", not exceeding $2,500.00 USD. By purchasing services from us, the Customer automatically agrees that they are of legal age to enter this agreement, and agrees that in reading this agreement in a language other than British English, they agree that the British English edition shall prevail in case of inconsistency or contradiction in translation or interpretation.

This agreement shall be governed by and interpreted and enforced in accordance with the laws of the United Kingdom of Great Britain and Northern Ireland, and any action in a court of law relating to this agreement must be brought in a court of law within the United Kingdom of Great Britain and Northern Ireland.
